These General Conditions establish, together with the other terms and conditions, the legal framework that will regulate the purchase of products through the website www.abbacino.es. This website belongs to the Entity SEYMA IMPORTACIO SLU, a legally constituted company, with registered office at C/ BELLAVISTA, 27 07520 PETRA, BALEARES, with CIF number B07713324 and registered in the Commercial Registry ILLES BALEARS in Volume 1907, Folio 183, Page 19925, Section 8.
I.-PRE-CONTRACT INFORMATION.
If you are under 18 years of age, you may not purchase and/or contract any of the products on the website www.abbacino.es. To purchase and/or contract any product and/or item on the website, you must be of legal age.
We recommend that you read these general terms and conditions prior to making a purchase, as their acceptance is a prior and essential step for the contract. Prior to the start of the contracting procedure, the company/entity makes these general conditions available to you so that they can be stored and reproduced by you.
We inform you that an electronic file of these general terms and conditions is produced, which will be accessible to you at all times. All the information provided during the contracting process will be stored by the company, and you, prior to contracting and during the purchasing process, may access, archive and print these general terms and conditions for consultation.
We inform you in advance of the procedures you must follow to accept these general terms and conditions. The procedures to contract the products offered are those described in these general conditions, as well as those specific ones indicated on the website during navigation, so that you as a client/user declare that you know and accept these procedures as necessary to acquire and/or contract the products offered on the website.
The contracting of our products may be formalised in any of the languages available on the website, at your discretion. However, the language in which these general contracting conditions are formalised is Spanish.

These conditions regulate the contractual relationship of sale and/or contract generated between the company/entity and you at the time you accept the corresponding box during the online purchase and/or contracting process.
The characteristics of the products purchased and/or contracted are reflected on the website.
Your purchase of any of the products and/or articles through the website www.abbacino.es implies acceptance of and compliance with these General Conditions of Purchase and the specific conditions that may apply to the acquisition and/or purchase of each of the products and/or articles.
The prices applicable to the products and/or items purchased and/or contracted by you are those indicated on the website on the date of contracting and/or acquisition. VAT is included in the price.
All technical means and requirements needed to access the website and the products and/or articles offered therein shall be the exclusive responsibility of the user.
Once you access the website, to proceed with the acquisition and contracting of the different products or articles you must follow all the indications and instructions included on the website, completing for this purpose the required contracting conditions and other forms established for each product, which will imply the reading and acceptance of these General Contracting Conditions, as well as, where applicable, the specific conditions that may be applicable.
IV. PURCHASE PROCEDURE.
If you are under 18 years of age you cannot purchase products from www.abbacino.es. To purchase any product from SEYMA IMPORTACIO SLU you must be of legal age.
The purchase of products must be made through the specific selection of the desired product and/or products using the purchase selection tools installed on the website. Once the purchase request has been selected and verified, you will have proceeded to the express total acceptance of each and every one of the contracting conditions, as they are shown on the company's website, and this implies the purchase of the requested products.
From the moment of acceptance, the user acquires the status of Client of the company/entity.
Any product or service subsequently offered by the company/entity must be the subject of a new contract.
The client is advised to read these General Conditions more carefully and print them on paper or save the document in electronic format.
In order to purchase any of the products on the www.abbacino.es website, the user must register their personal and/or professional details and choose a password that allows them to access areas that require prior identification. When your details are registered on our server, or when you make your purchase, your personal and professional details, address and details relating to your chosen payment method are incorporated into our database and are used exclusively to process the sale of the product purchased during the selected period and to send information about offers and information that may be of interest to you during the contracted period. At any time you can modify your customer registration details (address, contact telephone number, email address, etc.) or request a reminder of your password if you have forgotten it.
Once the customer account has been created, please be advised that in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:
1.-To start the contracting and/or purchasing process on the website www.abbacino.es, the user must select one of the products shown on the page.
The user can view and control the selected product(s) by following the purchase and/or contracting instructions on the website. The website will display the selected items, price and specific conditions.
Once the product selection has been completed, the user must proceed to payment and/or contract. The selected products will be shown, how many units, their prices, the VAT breakdown, the total purchase price and whether shipping costs are included. In the event that shipping costs are not included, the user/customer will be informed of the cost of shipping and/or delivery of the selected product and/or products. The user/customer can also apply any discounts available to them. At this point, the user can continue shopping or make the payment and/or contract.
2.-To make the payment, the user must be registered on the website. To do so, they must fill out a form with the requested data. Those data that are essential to proceed with the purchase will be marked with an asterisk.
The user may request, by checking the corresponding box, to receive newsletters and offers from SEYMA IMPORTACIO SLU and confirm the delivery and billing address.

In both cases, when paying with a VISA or MASTERCARD card, the following information will always be requested: the card number, the expiration date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD card, thus offering more guarantees about the security of the transaction.

5.- Finally, the user must confirm the contract. In any case, the Seller's contracting platform will inform the user once the purchase and/or contracting procedure has been completed.
IV. PRODUCTS AND/OR ARTICLES. LEGAL WARRANTY.
The product and/or item is offered on the website with a description of its characteristics that is as accurate as possible. In addition, this description includes information regarding after-sales services for the contracted product or service, if applicable, and the conditions of the after-sales services. In any case, information is provided regarding the commercial guarantees of the product or service, and their conditions.
Deadline for reporting non-conformity.
Please be advised that the time periods provided for in Royal Legislative Decree 1/2007 of 16 November will apply to the manifestation of a lack of conformity with the product and/or service. Likewise, if we are faced with one of the exceptions mentioned in art. 114.2 of Royal Legislative Decree 1/2007 of 16 November, the provisions of this point will not apply.

V. PRICE AND AVAILABILITY OF THE PRODUCTS.
The prices applicable to each of the products are those published on www.abbacino.es, indicated below each product. Prices are shown in euros.
Prior to the buyer accepting the contracting and/or purchasing operation, the prices of each of the selected and/or contracted products and/or expenses that will be applicable to the operation and the promotions or discounts that, where applicable, are applicable are clearly specified.
The Seller reserves the right to modify its prices at any time. In the event of a change in the sales price, the products will be invoiced according to the price in effect at the time of registration of the contract and/or purchase.
Any payment made to the Seller will result in the issuance of an invoice in the name of the client/user.
For any information about the contracted product, the user will have access to an email service at the email address info@abbacino.es. In any case, the subject of the message or the customer data must be indicated.
VI. DELIVERY OF PRODUCTS AND SHIPPING COSTS.
The purchased products are sent to the delivery address indicated by the Client, within approximately 2 to 3 working days for shipments in Spain, and 2 to 5 working days for shipments to the rest of the European Union for products in stock. In the event of not having stock, the Company and/or Entity will duly inform the Client of this fact as soon as possible. The Company/Entity will not be responsible for delays that occur due to causes beyond its control or force majeure.
Shipping costs are included in the final price when making the purchase and/or contracting.
Shipping to Spain/Portugal:
Standard Shipping (GLS)
- For shipments under €30 in Spain/Portugal, shipping costs will be €2.95.
- For orders over €30 in Spain/Portugal, shipping costs will be free.
Shipments outside Spain/Portugal:
- For shipments under €30 outside of Spain, shipping costs will be €10.
- For shipments over €30 outside of Spain, shipping costs will be free.
VII. VALIDITY OF THE OFFER.
Offers are duly marked. Products offered on the website will be available until any modification related to the product occurs, which will be announced one week in advance.
VIII. RIGHT OF WITHDRAWAL
The Contractor acquires the status of consumer and user, and in accordance with art. 68 of RD 1/2007, has the right to withdraw, having a period of 14 calendar days to do so. In accordance with art. 71 of RD 1/2007, since the object of this contract is the acquisition of a product, the period of days to exercise the right of withdrawal will begin to run from the date of receipt of the product.

IX. RETURN
The customer will have a period of 14 calendar days from receipt of the goods, or from the formalisation of the purchase if it is a service, to terminate the contract. The customer will notify the company/entity, within the stipulated period and by any means permitted by law, of their desire to exercise the right to terminate the contract.
The returned order must be delivered together with the delivery note and, where applicable, the invoice issued by the company/entity. The return costs will be borne by the customer.
The customer may return any item purchased from the company/entity as long as the product is in perfect condition, retains its original packaging and any manuals, accessories or promotional gifts included, if applicable.
Under no circumstances will changes or returns of custom-made items and confirmed special orders be accepted.
The return shipping costs will be borne by SEYMA IMPORTACIO SLU, except for international returns for orders of less than 60 euros, for which the return shipping costs will be borne by the customer.
Return shipping cost are borne by the entity SEYMA IMPORTACIO SLU, except for international returns whose order does not exceed 60 euros, whose cost of return shall be borne by the customer.
To request a return of products, the customer can use any of these methods:

b) By email to info@abbacino.es, using the return form that the customer can download here, and which can also be sent by email to info@abbacino.es. In this case, the customer must write RETURN FORM in the subject line.

The customer/user can return the product at any of the company/entity's physical stores in the national territory.
X. PROFESSIONALS
If you are a professional or entrepreneur, the provisions of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users, will not apply to this contract under any circumstances. In any case, if you are a professional or entrepreneur, the clause relating to the right of withdrawal and/or return will not apply to this contract.
XI. CELEBRATION OF THE CONTRACT
Contracts shall be deemed to have been concluded and shall produce all the effects provided for by law when consent and the other requirements necessary for their validity are met, and shall be governed by the provisions of Law 34/2002, of July 11, on information society services and electronic commerce (LSSI), art. 23 and 24, the Civil Code, the Commercial Code and other applicable civil or commercial regulations. If you are a consumer, this contract shall be deemed to have been concluded in the place where you have your habitual residence. If you are a professional or entrepreneur, this contract shall be deemed to have been concluded in the location of the registered office and/or establishment of the company/entity.
XII. MODIFICATION
The company/entity reserves the right to modify or replace these contracting conditions if new economic, commercial, regulatory and/or extraordinary circumstances arise that affect the sale of the product and/or provision of the service and/or aspects related to them that justify the modification of these conditions. Unilateral modifications of these conditions for justified reasons will in no case affect the contracting conditions of those products, services or promotions that have been contracted prior to any modification.
XIII. LIABILITY REGIME.
The company/entity will not be liable for problems arising from lack of access or problems inherent to Internet connectivity or electricity networks when these have their origin in causes beyond its control or causes that could not have been foreseen by the parties or that, even if foreseeable, the company/entity has made all reasonable efforts to avoid them or that are considered to be fortuitous causes or force majeure.
The company/entity shall in no case be liable for delay in the execution of its obligations or for non-execution of the same, if this non-compliance is motivated by reasons of force majeure, in accordance with the provisions of article 1.105 of the Civil Code. This circumstance shall be communicated to the other party as soon as possible. The agreed delivery times shall be extended by at least the period of time that the cause of force majeure has lasted. If the cause of force majeure were to last more than three (3) months, either party may terminate these contract conditions.
XIV.- PROTECTION OF INTELLECTUAL PROPERTY
The website www.abbacino.es is the property of SEYMA IMPORTACIO SLU. The trademark is duly registered in the name of SEYMA IMPORTACIO SLU. Likewise, the website www.abbacino.es, including but not limited to its programming, editing, compilation, designs, logos, text and/or graphics, are the property of SEYMA IMPORTACIO SLU and are protected by national and international regulations on intellectual and industrial property. Therefore, the owner of the rights expressly prohibits any use or reproduction, in whole or in part (by any physical or electronic means), by third parties, unless there is a written agreement or authorization to this effect.
Access by the user to the website does not grant him/her any ownership rights over the same. SEYMA IMPORTACIO SLU will exercise the legal actions provided for by law against those who knowingly and without authorization carry out any of the acts detailed.
XV.-APPLICABLE LAW AND JURISDICTION
These general conditions shall be governed and interpreted in accordance with Spanish law in all matters not expressly established. The parties submit to the jurisdiction of the competent Courts and Tribunals for any questions that may arise or actions that may be exercised arising from the provision of the website service and its services and content, and regarding the interpretation, application, compliance or non-compliance with the provisions of these general conditions. In the event that the user has the status of consumer, the Courts and Tribunals that correspond to the provisions of current consumer regulations shall be competent.
